Terms & Conditions
Please see below for full terms and conditions relating to portrait, event and wedding photography services.
In the following terms and conditions “the Photographer” shall mean Joy Louise trading as ‘Joy Louise Photography Ltd.’, “the Client” shall be those persons responsible for booking the photography services. It is agreed that the following terms set out the entire agreement made between the parties and that no variation or modification of these terms shall be effective unless agreed by both parties in writing.
Booking (excluding Weddings)
All photography sessions including any fixed cost discount packages will require you to pay in full upfront to secure your booking. However £50 of package cost will act as a deposit and be un-refundable in the event of a Client cancellation.
For special offers, discount codes must be inserted into the subject heading of the booking form otherwise the discount code will not be validated.
For portrait sessions these are calculated based on type of portrait session and approximate duration of session. However, the total length of the session is at the discretion of the Photographer on the day.
For event photography, time frame will be agreed during the booking process.
Booking (Wedding Photography)
All wedding packages including any fixed cost discount packages will require a deposit of £250 to confirm booking once a date is set.
Discount codes must be inserted into the subject heading of the booking form otherwise the discount code will not be validated.
The remaining photography session fee must be paid 6 weeks before the session otherwise the date will be cancelled, and the deposit retained.
Copyright
English Copyright Law states that the copyright of photographs remains with the Photographer. The Client does not own the rights to the photographs and may not sell, edit or otherwise tamper with the photographs delivered.
Model Release
The Client allows the Photographer to display any photograph taken by the Photographer, this may be to generally promote the business in advertising, brochures, magazine articles, websites, social media, sample albums etc.
The Client allows the Photographer to utilise any behind the scenes or video content captured for marketing purposes.
Limited License to Client
The Photographer grants the Client an exclusive, limited, royalty-free, non-transferable and non-sublicensable license to use Work Product for Client’s Personal Use, provided that Client does not tamper with photographs delivered in any way. This includes re-editing or the removal of copyright notices. “Personal Use” includes, but is not limited to, use (i) of photos on Client’s personal social media pages or profiles; (ii) in Client’s personal creations, such as scrapbooks or personal gifts; (iii) in non-commercial physical display; and (iv) in personal communications, such as family newsletter, email, or holiday card. The Client will not make any other use of the Work Product without the Photographer’s prior written consent, including but not limited to use of the Work Product for commercial sale.
Print Release.
The Photographer grants permission for the Client to print photographs for personal use, for example in the form of framed prints or albums.
Creative License & Coverage
Photographs taken during the course of the photography session/event/wedding will be at the discretion of the Photographer although every effort will be made to comply with the Clients’ requirements.
Special requests are not binding instruction, although every effort is made to comply with the Client's wishes. The Photographer will do their best to honour the requested photographs but cannot guarantee any specific picture nor the incorporation of any specific background, location or group arrangements due to changes in weather, location, plus the availability and willingness of subjects.
Due to a variety of lighting conditions and the limitations of digital sensors, some colours may alter throughout a set of photographs.
Photographer’s judgement regarding retouching and the number of images put forward to the Client shall be final.
Weddings
As Sneak Peaks are delivered within 48 hours of wedding therefore less time is spent on the edit with less consideration for the wedding gallery as a whole. Therefore final edit of the Sneak Peak images in the full wedding gallery may differ slightly if this improves the overall look of the final wedding gallery.
At a booking involving a church ceremony or at certain locations/venues, movements of the Photographer are sometimes restricted by the officials in charge of the venue. The area from which the Photographer is able to cover the ceremony may not be the Photographer's choice and the Photographer cannot accept responsibility for any obstructed view should this be the case.
The Photographer will be the sole professional photographer at the venues specified (unless second shooter booked through Joy Louise Photography). The Photographer does however positively encourage family, friends and other guests to take photographs throughout the day providing they do not obstruct or interfere with the Photographer. The Photographer cannot be responsible if family, friend and other guests or other wedding supplier obstruct or interfere with the Photographer.
During the booking and pre-wedding process, preferred timings shall be agreed along with the hours of coverage. Official timings for coverage will be confirmed in writing by the Photographer and must be firmly agreed a week before the date of the wedding with the Client.
The Photographer shall be entitled to take a break during the Wedding Breakfast where a meal to be provided if coverage of services exceeds 6 hours. This will also apply to any second shooters booked through Joy Louise Photography. If no meal is provided for the Photographer or any second shooters, the Photographer retains the right to go offsite to attain food, thereby the Photographer cannot be responsible if they have not returned to venue in time for the next moment to be photographed.
Limit of Liability (Images)
The Photographer will take all reasonable steps to ensure equipment is in good working order, backup equipment is available where appropriate and that images are backed up in a responsible manner. In the unlikely event of a total photographic failure or cancellation of this contract by either party or in any other circumstance the liability of one party to the other shall be limited to the agreed value of the contract. Neither party shall be liable for indirect or consequential losses.
Limit of Liability (Personal Accident)
Client agrees to indemnify, defend, and hold harmless the Photographer and their affiliates, employees, agents and independent contractors for any injury, property damage, liability, claim or other cause of action arising out of or related to the Services and or Work Product the Photographer provides to the Client.
Additional Expenses (Excluding Weddings)
No milage travel expenses are charged for photography sessions within 50 mile radius of PR26.
Additional mileage may be charged if the photography session is taking place on location outside of the 50 mile radius at a rate of 45p per mile.
Any entrance fees, parking fees or related expenses will be payable by the Client.
Photography sessions include digital delivery of the best images from the shoot. If the Client wishes to purchase prints, wall art or photo-books/albums these can be arranged at additional cost. Additional products will be arranged on receipt of full payment.
Additional Expenses (Wedding Photography)
No milage travel expenses are charged for weddings taking place within a 50 mile radius of PR26.
Additional mileage will be charged if the wedding photography session is taking place at a greater travel distance of 50 miles from PR26 at a rate of 45p per mile.
Should the Client's venue be more easily accessed by public transport, Client will be responsible for the covering the cost of public transport if the amount exceeds £20.
Accommodation may be charged for wedding photography sessions when the distance to venue cannot be completed in under a 2 and a half hour drive by car.
Any entrance fees, parking fees or related expenses will be payable by the Client.
Wedding Photography Packages include digital delivery of the best images from the shoot. If the Client wishes to purchase prints, wall art or photo-books/albums these can be arranged at additional cost. Additional products will be arranged on receipt of full payment.
Cancellations (excluding Weddings)
The Photographer will, at their discretion, accept cancellations and issue a refund depending on the amount of notice received prior to the agreed date.
More than 14 days notice, 100% of the monies paid less the deposit which is non-refundable
Between 14 to 10 days notice, 50% of the monies paid less the deposit which is non-refundable
Less than 7 days notice, no refund will be provided
Where the notice given is less than 7 days the Photographer may decide at their sole discretion to offer a gift voucher for up to 50% of total photoshoot cost which will be valid for 12 months.
On location photoshoot cancellations is at the discretion of the Photographer as both weather and condition of venue are outside of the control of the Photographer. If an on location cancellation is granted then the agreed photoshoot can be rearranged with no loss of money.
Cancellations (Wedding Photography)
The Photographer will, at their discretion, accept cancellations and issue a refund depending on the amount of notice received prior to the agreed date.
More than 12 weeks notice, 100% of the monies paid less the deposit which is non-refundable
Between 12-9 weeks notice , 75% of the monies paid less the deposit which is non-refundable
Between 9-6 weeks notice , 50% of the monies paid less the deposit which is non-refundable
Less than 6 weeks notice, no refund will be provided.
The Client acknowledges and agrees that the Client is not relieved of any payment obligations for cancellations within less than 6 weeks notice.
Cancellation (Causes beyond reasonable control)
In the very unlikely event of cancellation by the Photographer or of total photographic equipment failure, liability shall be limited to a full refund of any fees paid.
For events or weddings the Photographer will use best endeavours to send out an associate photographer to the Client(s) event or wedding. If this is not possible, the Photographer will provide a refund and do their best to put the Client in touch with another photographer to attend on the event/wedding date.
Examples of beyond reasonable cause include sudden illness, injury, victim of crime, flooding, traffic conditions, vehicle breakdown, equipment failure etc.
Force Majeure
For events to constitute force majeure, they must be unforeseeable, external to the parties of this contract, and unavoidable.
Should an event be cancelled due to force majeure then every reasonable effort will be made to re-book the session or event.
Should it not be possible to re-book the session or event, despite making every reasonable effort, then the deposit will be retained but any other fees paid will be returned to the Client.
